DISCLAIMER
BLUE LAGOON hereby agrees to supply a portable pool for the use in labour and/or delivery, or baptism by full immersion, to the specified named persons in the booking form for their own personal use, and guarantees its operation providing the equipment supplied is not damaged during the period of hire.
THE HIRER will agree to hire from Blue Lagoon a birth pool solely for the use in childbirth or baptism by full immersion, and agree to the Conditions of Hire and will pay the stipulated fee. The hirer also agrees that if no other arrangements are made they will return the epuipment supplied to Blue Lagoon clean (in accordance with our detailed cleaning instructions supplied) and in perfect working order, to arrive by, or be handed over on, the last day of hire (or before).
CONDITIONS OF HIRE
In the following:-
‘Equipment’ and ‘Birth Pool’ or ‘Baptismal Pool’ or ‘Pool’ shall mean the water pool and all ancillary items listed in the Inventory of parts provided with the contract.
‘Hire period’ shall commence with the signing over of the Equipment to the Hirer and shall end when the Equipment has been delivered complete and intact back to us.
1 For Birth Pool hires, the decision to use a Birth Pool is the responsibility of the pregnant woman and her partner and they must make this only after taking advice from medical professionals. If the conditions change under which this decision was made, such as a complication in the pregnancy, then the couple must take further advice because the use of the Birth Pool may then be undesirable.
2 Blue Lagoon recommends that a midwife be in attendance at all times when the Birth Pool is being used by the pregnant woman during labour and delivery. In hiring out this Equipment Blue Lagoon accepts no responsibility for a safe and problem-free birth.
3 Except in respect to death or personal injury caused by our negligence, Blue Lagoon does not accept any liability for any injury, consequential loss or damage, costs, expenses or other claims arising out of or in connection with the hiring of the equipment. In all events our liability is limited by our hiring fee.
4 Great care should be taken in operating and using the Equipment at all times. Particular care should be taken getting in and out of the Pool. We recommend that adequate provision is made for the safety of children and pets likely to be in proximity of the Equipment.
5 Great care should be taken when filling and emptying the pool and suitable safety precautions should be taken regarding the hose pipe and tap adaptor in all respects
6 It is the responsibility of the Hirer to ensure that the Pool is located in an appropriate place. Important considerations include the load-bearing capacity of the floor on which it stands; although the Equipment is light, at design depth each pool holds a significant amount of water (between 800 to 1000kg, approximately) so floors must be able to take this loading.
7 The replacement cost of the Equipment is £2,300 and if for any reason the Hirer cannot return it at the end of the hire period Blue Lagoon will be entitled to charge that sum and also the hire period will extend until another replacement Birth Pool is ready to hire out. This also applies to damage to the Equipment in that Blue Lagoon will have to charge the hirer the cost of repairs and the Hire period will continue until the repairs are complete. If the Hirer chooses to insure the equipment to cover the above then on proof of insurance this clause will be waived for all cases of accidental loss or damage but will not entitle the Hirer to retain the Equipment.
8 Any loss, fault or damage to the Equipment should be reported immediately to Blue Lagoon and no attempt made to repair it without our authorisation.
9 The Hirer is responsible for the Equipment at all times during the Hire period. The Equipment must remain in the Hirer’s possession and at the location indicated in the booking form and the contract throughout the Hire Period unless otherwise agreed by Blue Lagoon Birth Pools in writing. The equipment is for the sole use of the hirer.
10 The Hirer should ensure the Equipment is thoroughly cleaned with Titan Sanitizer (where specified in the instructions supplied) or wiped down, rinsed and dried as per the detailed cleaning instructions supplied, before the pool is returned or collected. The hirer must also ensure that the hoses are fully drained after cleaning otherwise a charge of £15 will be deducted from the £100 damage retainer deposit. Blue Lagoon will inspect the Equipment on its return and if all is well will return the deposit to the Hirer within 7 days of the return.
